Fynbos Consulting Terms of Service
1. Introduction
Welcome to Fynbos Consulting (Pty) Ltd ("Fynbos Consulting"). By accessing and using our services, you agree to comply with and be bound by the following Terms of Service ("Terms").
2. Services
We provide tax consulting and related services (collectively referred to as "Services") to individuals and businesses in South Africa. Our services include, but are not limited to the preparation of tax returns, assistance with the submission of Approval for International Transfer (AIT) applications and tax advisory.
3. Client Responsibilities
As a client of Fynbos Consulting, you hereby agree to provide:
3.1. Accurate Information: You agree to provide accurate and complete information necessary for us to provide the Services effectively. Any reliance on inaccurate information is solely at your own risk.
3.2. Documentation: You are responsible for providing all required documentation and information in a timely manner to ensure the proper provision of our Services.
3.3. Compliance: You acknowledge that it is your responsibility to comply with all applicable tax laws and regulations. We do not provide legal advice and cannot be held responsible for any legal consequences resulting from your failure to comply with the law.
4. Confidentiality
We will treat all information you provide to us as confidential. This information will not be disclosed to any third parties unless required by law or with your explicit consent. It is acknowledged by the client that the South African Revenue Service (SARS) may request information that Fynbos Consulting will need to provide in order to complete the agreed upon service arrangement.
5. Payment
5.1. Fees: Our fees for Services are outlined in the agreement provided to you separately. Payment is due according to the terms specified in the agreement.
5.2. Payment Methods: We accept payment in the form of electronic funds transfer (EFT).
5.3. Late Payment: In case of late payment, we reserve the right to suspend or terminate our Services until payment is received.
6. Limitation of Liability
We will provide our Services with reasonable skill and care. However, we will not be held liable for any losses, damages, or liabilities resulting from the use of, or inability to use, our Services.
7. Termination
Either party may terminate the engagement for Services by providing written notice to the other party. Upon termination, you are still responsible for any fees and expenses incurred up to the termination date.
8. Amendments
We reserve the right to amend these Terms at any time. Any changes will be communicated to you through appropriate means. Your continued use of our Services after such changes will constitute your acceptance of the modified Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
